Chapter Eighteen
As per usual, I was wide awake by 5:30 making my coffee, the only light on in the house was the one on the stove hood. I wasn't expecting it when Randy stumbled into the kitchen in his underwear. He said he'd been up for at least an hour; he hadn't slept much last night. I watched as he went to the cabinet, took out a mug and poured coffee in it.
"I didn't know you drank coffee" I said.
"I don't usually, but I'm not usually up at 5:30 either" he said, taking a sip. "I don't look forward to being placed in a foster home."
"That's not going to happen" I said.
"You must have not talked to the same social worker and psychologist I did" he said.
"We don't know what their reports are going to say" I said.
"I have a pretty good idea" Randy mumbled to himself.
I went out to sit on the porch with my coffee, Randy came along and sat next to me.
"Thanks for trying anyway" he said with a heavy sigh. I pulled him to me and felt his tears through my tee shirt.
Once the sun was up, we went to our separate bathrooms to shower and get ready for court. Luis joined me in the shower to save time; no horseplay this morning. Me and Luis both put on suits, and I tied both ties. Randy came out in khakis and a light blue button-down shirt. We walked to the truck as if we were walking to death row. Even taking our time, we still got to the courthouse 30 minutes early. We stood in the hallway about 15 minutes before Andrew and another man came in. Andrew introduced us to the older man, who was one of the senior partners Bill Denton. Andrew said he wanted to come along in case anything started going wrong. A few minutes later a bailiff came and unlocked the courtroom and we went in and took our places.
Across the aisle Ms. Burke, and the psychologist were sitting with the state lawyer.
The bailiff started his spiel, "All rise for the Honorable Judge Myron Drummond". We all dutifully stood up. "You may be seated" he said.
The judge looked over the report from Ms. Burke.
"Ms. Burke, your report summary states that you don't feel Mr. Oliver would be a suitable parent for Mr. Hall, however, the details in the report indicate otherwise. As you stated in your report, Mr. Oliver has sufficient and actually abundant means to support the minor, you have stated that the home is well kept and the minor has his own secure sleeping area complete with his own bathroom, you further state that Mr. Oliver and his partner became hostile when questioned about `inappropriate behavior' with the minor. I guess what I'm trying to understand is...why you do not think Mr. Oliver is suitable?"
"Well, your honor, social services do not feel it is appropriate to place this young man in a home with two homosexual men. We feel he would be better off fostered in a more traditional setting." She said.
"I'll take your recommendations under consideration" the judge replied.
"Dr. Plessick, similar to Ms. Burke's report, your summary says that while you do not believe Mr. Oliver or Mr. Garza to have any pedophilic tendencies, you still do not recommend approval of the adoption. Why is that?"
Dr. Plessick looked somewhat uncomfortable. He said "Having a minor male, who is confused in his sexuality, placed in a home with two homosexual men, in my opinion, is just asking for something to happen, your honor."
"Not confused!" Randy interrupted, getting a stern look from the judge.
The judge said, "You already said the two men showed no traits associated with pedophilia, so what?"
"Your Honor, the youth is already sixteen years old, in a year he will be of legal age for consensual sexual relationships. If he is already in a home with such activity going on, what is to stop him from joining in?"
"Nothing, however, at that age there would be no laws being broken" the judge said.
Mr. Denton stood up "Your Honor, if I may approach the bench for a small sidebar..."
The judge waived him up and turned off the microphone while they talked. They were too quiet for us to hear what they were saying, but the judge nodded his head and Mr. Denton walked back to us. The judge turned the microphone back on.
"Ms. Burke" he said, "It has come to my attention that you have quite a past. Would you tell the court about your connections to a radically homophobic church in Topeka, Kansas?"
"There's really not much to know, your honor" she said, "I was a member of that church at one time."
"At one time...I see" The judge said, "Ms. Burke, please tell the court what role your uncle played in that organization."
"I don't see what my uncle's role in a church has to do with these proceedings" she said in a huff.
"I think having Fred Phelps as an uncle, would taint any recommendations you might have concerning an adoption by two gay men" the judge said.
"I'll assure you I am impartial, your honor" she said indignantly.
"Ms. Burke, I'd like you to know your participation in these proceedings is highly unethical, due to your predisposition to homophobia. I'm recommending that your license be reviewed as I am not satisfied that you are fit to be handling cases such as these."
"As for you Dr. Plessick, since you do not expound on any specific and certain psychological breaks that could befall Mr. Hall due to his being adopted by Mr. Oliver, I will thank you for your time."
"Randall Hall, please stand" the judge said. "Mr. Hall, in the case of an adoption proceeding, the most important opinions are those of the adopter and the adoptee. Do you feel that you are being coerced by Mr. Oliver, in any way, to agree to this proceeding?"
"No sir, Jackie loves me more than James and Deena ever did, and just for the record, when I first went to stay with him, I tried to get him to do...stuff...with me. But he literally ran me out of his room. Jackie and Luis are all either one need, why would they fool around with a kid?"
"Thank you, son" the judge said, "you can sit down now."
"Mr. Oliver, Jackie, are you sure you're up to the task of taking over this boy's welfare, keeping him safe and healthy into adulthood?"
"Yes sir, your honor, I know what people like Eileen Burke think of us; nothing but filthy perverts, but I promise you I've never had any designs on Randy. I wasn't even sure at first that I wanted to get involved, but when I saw how willing my brother-in-law and my sister were to relinquish their custody, not even a peep of an argument, I knew I had to take him on. He's too good a kid to be thrown away like he doesn't matter. I'll do whatever I can to make his life happy, sir."
"In regards to the adoption petition brought forth by Mr. Jackson Oliver requesting adoption of the minor child Randall Edward Hall, the petition is granted. Congratulations Mr. Oliver and congratulations to you Randall Edward Oliver."
Randy turned grabbed both me and Luis in a giant hug. Ms. Burke looked like she had eaten something that disagreed with her. We went to the court clerk and got a copy of the adoption paperwork and in the hallway, I asked Mr. Denton what he said to the judge. He said he went up to tell the judge about Ms. Burke and her family connections, but that the judge somehow already knew. We walked outside and I clicked my phone back off silent and it almost immediately started ringing. I answered and it was my friend "Teddy Bear" Judge Melton.
"Congratulations!" he said.
"It was you, wasn't it" I said.
"Well, Andrew's mentor gave me the information, I just happened to mention it to Myron during our golf outing" I could almost see him winking through the phone. "Besides, guess what brought up the subject of your case?"
"No idea" I said.
"Myron's youngest son, Dwayne, just came out to him. Seems he's had gayness on his mind a lot lately."
"It stays on my mind a lot!" I laughed. "Thanks Ted, you know I owe you one."
"I'll take homemade lasagna, garlic bread, chianti and maybe you could throw in a blowjob..." he laughed.
On the way home, we went by Benton's and when we walked in, I found Miss Ellie and said "Miss Ellie, let me introduce you to my son, Randy Oliver."
"Oh my God! Congratulations!" she was ecstatic for us. "Next thing you'll be telling me you and Luis are getting married!"
Luis looked at me with those big brown eyes, "Don't start with me right now" I said smiling.
We pulled up to the house and Wayne's truck was in the yard. We found him with Felipe on the back porch drinking a beer. Randy went out to tell them the news while me and Luis went to lose the suits. I hung the suits up, pulled off my boxer briefs and started pulling on my `marginal' basketball shorts and a tank top. It was hard to get them pulled up with Luis' hand cupped under my balls. I gave him the no-no sign and he pulled his shorts up so we could join the others.
"Congrats! Jackie" Wayne said.
"Thanks, Wayne" I said.
"So, what's the story with you and my cousin?" Luis asked, "did ya love him and leave him?"
"No, it's definitely...a...thing" Randy said, "We're trying to figure it out."
"Okay?" Randy said, looking confused.
"Well, I love my place, and all my friends are here. I love being in the country. Remy likes the big city; he has a lot of friends in Denver. Denver is beautiful, by the way. I don't know...we're trying to see if there's a compromise we could make; some way to make it work. Right now, the only thing we've come up with is either a 13 ½ hour drive or a lot of airfare."
"Do you love him?" I asked.
"You know how I am about that kind of stuff, Jackie" he said, a non-answer.
"If you can't immediately answer `yes' to that question, I'd just keep driving or flying" I said.
"If it turns out to not be nothing but lust for a piece of ass when all's said and done, it's not worth uprooting both of y'all's lives. All that would do is end up making you hate each other when you part ways" I said. Luis nodded.
"Well, do you and Luis love each other?" he said in a kinda smart-ass tone.
"Without a doubt" I said at the same time Luis was saying "With all my heart" neither of us gave any hesitation. Wayne looked flummoxed.
"Luis, let's go do filthy perverted things to each other" I said, winking at my man.
"I thought you'd never ask" he said.
