"My Rules" Chapter 45
Matt was nervous as he sat in the chair in the courtroom. He had chatted over the rail with Connie for the last thirty minutes. "Don't worry Matt. I know what I am doing ." Connie kept saying. Matt had tried to get Billy to skip the trial but he would have no part of it. "Billy please assure me that you will not blurt out a comment, roll your eyes or make any noises." Matt said. "I know how to behave." Billy said. "We are about to find out." Matt said and smiled.
"All rise. The honorable judge Wilson presiding." The bailiff called out. Once seated the bailiff read the charges in the case of the State of Georgia verses the young man. The judge looked at Matt. "Are the attorney's in front of you retained by you to protect your interests ?" he asked. "Yes your honor." Matt said. "I have read the request from the attorney's office and understand and will allow it. I will warn you all that this trial will not be turned into a circus. It is my understanding that you are on the witness list so you can leave for the witness room while I charge the jury and open the case. Was your firm represented in jury selection ?" he asked. "No your honor our interest in the trial has no bearing on jury selection." Connie said. "I object." came from the young man's attorney.
"This is nothing more than a ruse to confuse the jury and prejudice them against my client." he said. "Save it for the trial. I will determine relevence. Over ruled." he said. The opening statements were made. Connie declined when the judge asked if she had any opening statement. "The only thing I would like to say to the jury is that I am not here on behalf of the prosecution or defense. My sole purpose is to protect my clients interest." Connie said. "Jurors in cases such as this the attorney that just spoke will not take part in any part of this trial unless the dignity or character of their client is challenged. They also have the right to recall witnesses and cross examine if it is in the best interest of their client." He said.
The prosecution began with the 911 call center operator that received the distress call. Next were the deputies and first responders. Billy was anxious because they had not called any witnesses from the building supply store. Lastly the prosecution called Matt to the stand. The prosecutor read the incident statement that Matt had given at the time of the incident. "Were these your words ?" the prosecutor asked. "Yes sir." Matt said. "Do you have anything to add to this statement ?" he asked. "No sir." Matt said.
The defense attorney stood. "Is it your common practice as a "gay" man to have all men arrested that turn down your advances ?" he asked. After the prosecutors objection was set aside at Matt's request he answered. "I did not flirt with that boy and had no interest in him both personally or sexually." Matt said. "Did or did you not also provoke his mother in a public place to the point of confrontation ?" he asked. Connie was quick to object beating the prosecutor to it. "I would like to enter into evidence eight sworn testimonies from employees and customers present to the contrary of my learned colleagues statement." she said. "Your honor that incident is not on trial here." the defense attorney said. "You are the one that brought it up. I will admit it." the judge said. The judge read the statements. "The jury is instructed to disregard the question as it is clear to the court that is not what happened." the judge said.
"It is my understanding that you also advised a friend to sign divorce papers from his wife so that he could begin a homosexual relationship ?" the attorney asked. "Objection. Relevance?" The prosecutor said. "May I answer your honor ?" Matt asked. "Go ahead." he said. "I advised a friend to sign divorce papers that you had drawn up on behalf of his wife. You are the one that drew up the papers to be signed." Matt said. "Move on or I will hold you in contempt myself." the judge said to the attorney.
After a short break Billy was about ready to strangle Connie. The defense attorney called different employees of the young man's father and had them testify that Matt had also flirted with them. "Will you stop kicking my chair and let me do my job." Connie turned giving Billy a stern look while the last witness left the stand. During the witness process the boy's mother was called to the stand. When the defense attorney tried to slide in incident at the store the judge had to remind her that perjury under oath was a felony. Connie added in that she had with her and would gladly enter into evidence the surveillance footage from the store. With audio. The mother and the question were both dismissed.
Last but not least the defense called the defendant to the stand. As he was making his way to the jury box Connie turned to Billy. "Now you will see why I get paid the big bucks." The young man was sworn in. The first few questions were of really no interest. The attorney was trying to make the young man out as a saint in the community. After a few more questions Billy was about to break the leg on Connie's chair kicking it. "So the physical abuse that you inflicted was requested ?" the attorney asked. "Yeah the fag wanted it rough but I only gave him the rough part. I don't want sex with no man." The young man spat.
The prosecution asked just a few questions because he had realized that Connie would easily win his case for him and did not want to trip her up. "Your honor may I take my opportunity to cross examine ?" Connie asked. "Granted." the judge said since he had wondered why he had not had a day full of objections from Connie.
"You say that my client tried to seduce you." Connie said. "Yes." The young man said. "Was the time of this incident prearranged by you and my client ?" Connie asked. "Do what ?" he asked. "Did my client ask you to meet him at his house at a certain time and day ?" Connie asked. "No." he said. "So you were there to surprise my client and fulfill his fantasies then correct ?" Connie asked. "Hell no." the young man laughed. "Then why were you at my clients house ?" Connie asked. The defense tried to object but had no grounds to have the question dismissed. "He flirted with me. All fags want dick. I was there to show him that straight men don't tolerate that." the young man said and puffed his chest in pride.
"So you were there for rough sex then as you stated earlier ?" Connie asked. "Hell no he wasn't going to touch me. They all like that rough shit. Look at the movies. All those fags prance around in leather harness and have those nipple clamps on. They like it rough." he said. "As you were going through the drawers in my client's home did you find any of these leather things that you spoke of ?" Connie asked. "No but I did find some of those fake plastic dicks. You know the kind they shove up their asses." the young man said while his attorney tried to object while he spoke. "Sustained." the judge said.
"So you were not there to fulfill a sexual fantasy of beating a man while having sex?" Connie asked. "Hell no bitch. The mother fucker would not open the safe. IF he had opened the safe I would have only hit him a couple of times." he said. "Was the television, jewelry and the SUV a prize for him flirting with you ?" Connie asked. "Fuck no but he is a faggot and rich. Hell he had insurance he just should have given up the shit and I would not have had to hurt him." the man shouted. "No further questions your honor." Connie said and headed back to her chair. "The defense rests your honor." the young man's attorney stated. Closing arguments began and Connie declined making any statement on behalf of Matt.
Matt and Millie walked out of the witness room in the courthouse. "Better watch that boy." Millie said as they saw Billy hugging Connie in the hallway. "What are you two up to ?" Matt laughed. "I thought I was going to have to stop the trial and beat the crap out of this man." Connie laughed. Matt looked strangely at Billy. "I kept kicking her chair." Billy said. "That was bold on your part but why would you do that ?" Matt asked. "They were saying some really ugly things in there and I thought she should object." Billy said. "Like what ?" Matt asked. "That's not important. Do you understand now why I waited ?" Connie asked. "Boy you tore that guy a new asshole. Did you see the judges face ?" Billy said. "I had to let him and his attorney open the doors for me to use my line of questions. If I had objected and the judge rule in my favor I could not have used the questions I did." Connie said.
"Excuse me ma'am. The judge would like to see you in chambers if you have a minute." The baliff said as he walked up. "Excuse me guys. I will be right back." Connie said. "Now that is one tough bitch. I wish I could have seen her in action." Millie said. "She is tough when it comes to law but how do you know that ?" Matt asked. "The way she carries and presents herself. That woman ain't scared of shit." Millie said.
Connie returned shortly. "You get scolded by the judge ?" Billy asked. "No. He thanked me for my professionalism. He said that he was use to the lawyers around here and that it felt good to be challenged with a new attorney in respect to trying to figure out their direction and motivation in the case." Connie said. "He seemed to be a nice judge." Matt said. "Yes he was. The district attorney offered me a job." Connie said. "Are you going to take it ?" Billy asked. "No. The county doesn't pay as well as we do." Matt laughed. "I like litigation every now and then but it's not for me." Connie laughed. The defense attorney was standing at the other end of the hall when Connie spotted him. "Wait right here I have one more order of business while I am here." Connie said as the smile dropped from her face. "Uh oh. That must have been her lawyer face." Billy laughed as she walked towards the attorney.
Connie introduced herself to the attorney. "It's nice to meet you. I can see you know how to push all the right buttons on witnesses." he laughed. "I would not have made it to be one of the top attorney's in the state if I didn't know my way around the courtroom and witnesses." Connie said. "I hope you didn't take anything I said about your client personally." he said. "That is not what I needed to speak to you about. I need to speak to you about Ty's divorce." she said. "I guess I need to call him and get those filed." he said. "No need to. His divorce is already final. I handled that myself. I just wanted to remind you that I have a copy of your original papers. They state that once "you" completed the divorce that Ty would pay the fees. I finalized it and have been paid so if you try to collect a single penny from him I will be the one coming after you. As for that in the courtroom, that was easy. You try to collect from Ty and you will see just how good an attorney I really am." Connie said. "Well if it is complete then I need to get paid." he said. "Get over it or be prepared to see me at the apposing table in the courtroom." Connie said before turning and heading back to her group.
"Is everything alright ?" Billy asked. "It is now. A little birdie told me that he was trying to make Ty pay him for the paperwork he did for the divorce." Connie said. "I will pay it and don't mention it to Ty." Matt said. "No you don't. After his little show in the courtroom I told him that Ty's divorce was final and paid for. Further more if he tried again to collect any money that it would be me he met in court sitting across from him and when I was finished it would not be pretty." she said. "I know that you represent Matt but do you represent me too ?" Billy asked. "Sure do. What's up ?" Connie said. "Nothing yet. Just making sure." Billy laughed. "As much trouble as these boys get me in I need to start saving my money in case I need you too." Millie laughed. "If you ever need my services Millie you just call. Yours will be pro bono." Connie said. "I can see you are a pro." Millie said. "She means free old woman." Billy laughed. "Keep that up and I will need her even sooner after I whoop that ass." Millie said.
The prosecutor walked up. "The jury is in." he said. "Damn that was quick." Billy said. "Sometimes that is a good thing." Connie said. The four went and sat in the courtroom. The judge and jury returned. Once called to order the judge charged the jury one more time before having the chair person read the verdicts. The young man was charged with seven counts. In less than thirty minutes of deliberation the jury had found him guilty of six out of the seven. "He should have been guilty of all of them." Millie said. "The prosecutor knew what he was doing. The not guilty one was the easiest one the guy would have been able to appeal. " Connie said. The judge set a sentencing date before thanking and excusing the jury.
Billy drove Matt's vehicle home. Matt rode with Connie to take some papers for Martin to sign. Martin knew of the visit thankfully so he was fully dressed. Ty was home for lunch and was trying to convince Martin to walk around naked just for him. Ty was laughing as Martin answered the door. "Come on in. Here." Martin said as he handed the infant to Connie. "Will you promise to take this one with you and send him home after Billy has worked the shit out of him." Martin laughed. "Working from home has it's draw backs I see." Matt laughed. "Most days no but today, yes." Martin laughed. "You know you love me." Ty said laughing.
"Alright you two. I am not use to holding things this small." Connie said. "He won't bite. He doesn't have teeth yet." Ty laughed. "You need a couple of those yourself. " Martin said. "My husband keeps saying that too." Connie laughed. "We will have at least one more as soon as I can get Martin pregnant." Ty said. "Don't pay him any attention. Billy has been with you guys all day so he has had no guidance." Martin laughed.
"I wonder why they charged the guy with a hate crime ? You don't see that very often and especially when gay people are involved in Georgia." Matt said. "It did not take much convincing." Connie said. "You did that ?" Martin asked. "It only took about three phone calls to the District Attorney." Connie said. "Phone calls ?" Matt asked. "Since I was representing you I had him send me all transcripts. Once I got the copies and read them I called and told him I wanted it upgraded to a hate crime. He said he didn't feel like that was needed. The next call was to tell him that I would have a team of attorneys arriving to look over every case he had prosecuted in the last ten years and would file ethics complaints against him for every infraction we found. It only rook about forty eight hours for me to get an email stating that the charges had been upgraded to a hate crime." Connie said. "Damn. You scare me." Ty laughed.
"It looks like Will and Martin are in good hands. I need to get home and get busy and you need to get to work so if you don't mind I will ride with you." Matt said looking at Ty. " We should be celebrating." Ty said. " We are and you can do it at work." Matt laughed. "Damn you are worse than Billy. " Ty laughed. They said their goodbyes and headed to Matt and Billy's to find Billy. "I want to tell you ahead of time that Martin may be a little upset when you get home. Connie said that she needed to talk to him but she assured me that it was nothing for anyone to worry about. She said that Martin would be upset to begin with but she was sure by the time she spelled everything out to him that he would be fine." Matt said.
"I need to go back." Ty said. "If Martin calls you yes. If not , no. I am not sure what it is all about. I do know it's not about his job but this one I get the feeling you need to let him tell you. I only mentioned it because I did not want you to freak out if Martin seemed a little stressed when you got home." Matt said. "What is it ?" Ty asked. "I am not really sure." Matt said. "I bet you know everything about it." Ty said. "No Ty I don't. I don't get involved in personal things with you and Martin or anyone else unless I am asked. So I don't know." Matt said.
Martin lay Will down for his nap. Ashton had been given a daycare jail reprieve today to stay home with Martin. He and Connie sat on the couch while Ashton play on the floor in front of them. "I hate to bring this up because I don't know your family situation but your boss contacted me. The had the Department of family and Children services in California contact them. Apparently your home town got a copy of the picture of you, Ty and the kids and ran an article. There was some lady claiming to be a family member call with allegations of child molestation. " Connie said. "That BITCH." Martin growled. "Was this your Mom ?" Connie asked. "I doubt it. I am sure that it was my Aunt. " Martin said. "She said her husband was a preacher." Connie said. "That's her. The bitch from the depths of hell itself." Martin said. Connie saw a tear forming in Martin's eye.
"Don't stress. It has all been handled. I even told them that you did not live in California and that it was out of their jurisdiction. We do need to talk about it though and get this out of the way." Connie said. "What do we need to do ?" Martin asked. " First off I need any information that you may have that I can use against them. Next I need your permission to use it. Once that is accomplished then we contact Georgia DFACS ( Department of Family and Children's Services. ). That way we already have them cut off at the pass." Connie said. "Whatever it costs. I will not loose my family to that bitch." Martin said. "That's not going to happen. We have already started part of it." Connie said. "Let me get my check book." Martin said. "No need. There is a clause in the contract with your company that we are to defend the integrity of any employee the company tells us too. Your boss told us to fix this. I just needed to talk to you about it." Connie said. "Got a pen and paper. I will give you everything you need." Martin said.
Within an hour Martin was pleased with the information that he had given Connie and the two together had written an article. "I need to double check a couple of these facts so there is no legal backlash but I think this will do the trick. Make a copy of this and read it a few times to see if there are any changes you want to make. Once we have these couple of facts researched and you are happy with the article we will pay for a full page add with pictures in your hometown paper. That will cause them enough grief that it will be easy to discredit them with DFACS." Connie said. "You are a saint." Martin said. "No saint just a damn good lawyer so don't you worry about this at all." Connie laughed.
"What do you think DFACS will do ?" Martin asked. "Probably an in home visit to verify that the children are in no danger. What I will have you do is bring them both to Atlanta and we will have a doctor at Children's Health Care of Atlanta do full exams on both. We will do that before we contact DFACS." Connie said. " I need permission for one more thing. I need to be able to discuss this with Matt and Billy. They will be huge assets in this case. If you do not want me discussing it with them I need you to promise me that you will tell them everything if we expect this to work." Connie said. "The only thing I ask is that you do not discuss anything with them that you are not willing to discuss with me. I don't have to be first I just will not tolerate being left out." Martin said. "I would not think of it." Connie said.
